WARRANTY STATEMENT

GoldStar Asphalt Products (“GSA”) warranties the  performance of its materials for 1 year under the terms of the following limited warranty and subject to the terms and conditions outlined below:

 1. Specifications Compliance: All materials picked up at our facility or delivered to your job site are guaranteed to meet our designed specifications. Any claims regarding material thickness or failed performance must be made within 48 hours of delivery and prior to any dilution.

 2. Exclusions: Warranty claims for materials that have been diluted beyond recommended levels or that have been applied to failed asphalt surfaces, oil spots, or over-aged asphalt surfaces, are not covered under this warranty.

 3. Limitations:

  • Crack Filling/Sealing: GSA does not warrant against cracks reopening due to soil or surface expansion and contraction.
  • Adhesion to Older Seal Coat: No warranty coverage is provided for adhesion issues with older seal coats that have delaminated or are in the process of delaminating from the original pavement surfaces.
  • Power Steering Marks: No warranty applies to damages caused by power steering marks.
  • Non-Asphalt Applications: No warranty applies to seal coat material that has been tracked or sprayed onto non-asphalt surfaces, including concrete, bricks, or siding.
  • Third Party Damages: No warranty applies due to damages or interference of others during application or immediately after application prior to the material drying.

Applicator’s Responsibilities for Liquid Asphalt Product Warranty:

As an applicator using GoldStar Asphalt Products’ liquid asphalt materials, you are responsible for adhering to the following guidelines to ensure warranty coverage:

1. Proper Application: The liquid asphalt product must be applied according to the manufacturer’s recommended guidelines and industry best practices. Any deviations from the specified application procedures may void the warranty.

2. Material Dilution: Ensure that the liquid asphalt product is not over-diluted during the application process. Dilution beyond the recommended levels may affect the performance of the product and could impact warranty coverage.

3. Surface Preparation: Properly prepare the surface before applying the liquid asphalt product. Surface cleaning, repair of cracks or defects, and ensuring proper adhesion are critical steps to ensure the product’s effectiveness and warranty coverage.

4. Adherence to Specifications: Verify that the liquid asphalt product meets the required specifications for the specific application. Any deviations from the recommended use or applications on unsuitable surfaces may not be covered under the warranty.

5. Documentation: Maintain detailed records of the application process, including dates, quantities used, dilution, surface preparation steps, and any other relevant information. Accurate documentation will be essential in the event of a warranty claim.

6. Timely Reporting: In case of any issues or concerns with the application or performance of the liquid asphalt product, report them to GoldStar Asphalt Products promptly. Failure to report issues in a timely manner may impact warranty coverage.

7. Compliance with Terms: Ensure that all terms and conditions of the warranty provided by GoldStar Asphalt Products are followed diligently. Failure to comply with the warranty terms may result in the denial of warranty claims.

8. Training and Knowledge: Ensure that the individuals responsible for the application of the liquid asphalt product are adequately trained and knowledgeable about the product, its application requirements, and potential issues that may arise.

9. Quality Assurance: Implement quality control measures to monitor the application process and ensure that the liquid asphalt product is applied correctly and effectively.

5. Disclaimer: GSA shall not be liable for any damages, losses, or claims arising from the use or application of its materials under this warranty.

6. Claims Process: To file a warranty claim, customers must provide detailed documentation and evidence to support the claim within the specified time frames outlined in this warranty statement.

7. Effective Date: This warranty is effective from the date of delivery of the materials and is valid for a specified period as per the terms outlined above.

 

GSA reserves the right to make any site corrections and or supply contractor with product to make corrections. Warranty claims for labor or equipment usage by user will not be covered.
